Est-ce que l\u2019employeur peut le refuser ?<\/strong> La r\u00e9ponse n\u2019est pas si simple et d\u00e9pend de plusieurs facteurs : <strong>code du travail, conventions collectives, usage dans l\u2019entreprise, politique RH\u2026<\/strong><\/p>\n<p>On fait le point de mani\u00e8re claire, avec des exemples concrets.<\/p>\n<h3>Le droit du travail <strong>ne pr\u00e9voit aucun cong\u00e9 d\u00e9m\u00e9nagement automatique<\/strong><\/h3>\n<p>Contrairement \u00e0 ce que beaucoup de salari\u00e9s pensent, <strong>le Code du travail ne reconna\u00eet pas le d\u00e9m\u00e9nagement comme un motif ouvrant droit \u00e0 un cong\u00e9 l\u00e9gal sp\u00e9cifique<\/strong>. Cela signifie qu\u2019aucun article de loi ne pr\u00e9voit qu\u2019un salari\u00e9 peut s\u2019absenter de son poste pour cause de d\u00e9m\u00e9nagement, sauf disposition pr\u00e9vue ailleurs. Cette absence de cadre l\u00e9gal rend la situation parfois floue, car certains cong\u00e9s (comme ceux pour mariage, d\u00e9c\u00e8s ou naissance) sont clairement encadr\u00e9s, alors que celui pour d\u00e9m\u00e9nagement <strong>rel\u00e8ve d\u2019un accord entre l\u2019employeur et le salari\u00e9, ou d\u2019un texte externe<\/strong> (convention collective, accord d\u2019entreprise, ou usage \u00e9tabli). R\u00e9sultat : un employeur <strong>n\u2019a aucune obligation de vous accorder un jour de cong\u00e9<\/strong> pour faire vos cartons ou emm\u00e9nager dans votre nouveau logement. En revanche, cela ne signifie pas que le cong\u00e9 est impossible\u2026 mais il d\u00e9pend d\u2019autres sources que la loi.<\/p>\n<p>Cela signifie :<\/p>\n<blockquote><p>? <strong>Aucun droit automatique n\u2019existe pour demander un jour de cong\u00e9 d\u00e9m\u00e9nagement.<\/strong><\/p><\/blockquote>\n<p>Mais \u00e7a ne veut pas dire que c\u2019est impossible\u2026<\/p>\n<h2>Les 3 cas o\u00f9 <strong>un cong\u00e9 d\u00e9m\u00e9nagement est autoris\u00e9<\/strong><\/h2>\n<p>M\u00eame si la loi ne l\u2019impose pas, il existe <strong>3 cas fr\u00e9quents<\/strong> o\u00f9 le salari\u00e9 peut bel et bien obtenir un cong\u00e9 :<\/p>\n<h3>1. \u2705 <strong>Une clause dans la convention collective ou l\u2019accord d\u2019entreprise<\/strong><\/h3>\n<p>De nombreuses conventions collectives pr\u00e9voient <strong>1 jour de cong\u00e9 pour d\u00e9m\u00e9nagement<\/strong>. C\u2019est le cas par exemple :<\/p>\n<ul>\n<li>de la convention <strong>Syntec<\/strong> (informatique, ing\u00e9nierie),<\/li>\n<li>de la convention <strong>Immobilier<\/strong>,<\/li>\n<li>ou encore du secteur <strong>Banque<\/strong>.<\/li>\n<\/ul>\n<blockquote><p>? \u00c0 v\u00e9rifier sur votre bulletin de salaire (code IDCC) ou aupr\u00e8s de vos RH.<br \/>\n? Conseil : le site <a href=\"https:\/\/www.legifrance.gouv.fr\/\">Legifrance<\/a> permet de consulter gratuitement les conventions collectives.<\/p><\/blockquote>\n<h3>2. \u2705 <strong>Un usage ou une tol\u00e9rance dans l\u2019entreprise<\/strong><\/h3>\n<p>Certaines entreprises ont <strong>l\u2019habitude d\u2019accorder un jour de cong\u00e9<\/strong> (ou une demi-journ\u00e9e), m\u00eame si cela ne figure pas dans un texte officiel. Cela s\u2019appelle <strong>un usage d\u2019entreprise<\/strong>.<\/p>\n<blockquote><p>? Bon r\u00e9flexe : demandez \u00e0 vos coll\u00e8gues ou consultez l\u2019intranet RH.<\/p><\/blockquote>\n<h3>3. \u2705 <strong>Un jour pos\u00e9 au titre d\u2019un cong\u00e9 pay\u00e9 ou RTT<\/strong><\/h3>\n<p>M\u00eame en l\u2019absence de droit sp\u00e9cifique, <strong>vous pouvez toujours poser un cong\u00e9 classique<\/strong> (CP ou RTT) pour d\u00e9m\u00e9nager.
